COMMENT: Well Bruce, Jackman J is not "sitting as an appellate court", but His Honour is the unfortunate soul who has to step in to finish what should have been determined by Farrell J.
Given the parties have been waiting years, & His Honour's the one who has to fix it up, it is reasonable to express a bit of frustration, and empathy for the long-suffering parties. COMMENT: Craig, if you read the decision (link in the story), you will see that Jackman J has stepped in and done the job for HH.
